I asked the question this a.m. re. CPAM administering the 'complémentaire' part of CSS and was assured that they are still doing it. So we're in agreement there :D Can't agree with your assessment that we're not affiliated to l'assurance maladie, though. I'm sure, technically, we are. There was a period when we contributed via URSAAF until OH's S1 kicked in. We also paid contributions to the CSS as our revenu + the forfait propriétaire excluded us from the 'free' version.
Anyway, CPAM's solution to the situation was to propose that we re-affiliate as French citizens. I think this is going to create far more bureaucratic problems than it solves, but the fonc was adamant that the change in the law (that she declined to pinpoint or provide proof of) took effect from 1/4/22. So it looks as though the only recourse for Brits with a TdS is the British Ambassador, RIFT etc. if only to clarify the situation.

I hope you are correct about being affiliated to l'assurance maladie, although re-joining as French citizens should remove any doubt.

However, the attachment below, suggests that the fisc considers we are not - although I don't think they control l'assurance maladie.

Facebook page RIFT posted yesterday 27/6/22 that those who have an S1 are not eligible to be in PUMA and are therefore not eligible for CSS/C2S because they are supported by another social security system.

I just checked on FB Strictly fiscal because I wondered if I should have tick 8RP/8RQ and found this
“The italics to the side of 8RP and 8RQ say it is to be ticked if you have made an entry in boxes 1TT/1UT.

So I don’t have to tick those two.

Yes, confirmed by the latest trip to Agen. We were given a copy of the circular sent round to CPAMs (not dated) from the Ministère de la Santé. They are applying a stricter interpretation of the existing law to exclude 'migrants permanents'. The French nationality angle won't work either, unless one has worked in France and is affiliated through a caisse.

So, do I apply for my S1 next year (when I get to 66) or just keep going as I am currently?

No idea, p4psb! It's certain that if you currently benefit from CSS you won't do once you register an S1 with CPAM. We don't know your circumstances, so don't know by which route you're affiliated to l'Assurance Maladie, or to PUMA. I wouldn't like to offer advice either on the tax and social charge implications :shock: Perhaps the exemption from social charges on UK pensions will be the next target..who knows?

We (the wife and I) have been here since 2006, inactive with UK Government pension.
Tax return usually results in nil contribution.
My CPAM code gestion is 89.

It seems that this loss of eligibility for CSS affects those enjoying cover by l'Assurance Maladie through an S1, who are no longer considered as being actually affiliated to l'Assurance Maladie.

As the S1 form is used by all EU countries to provide medical care facilities for the holder in another (EU) country, then this ruling should affect all nationalities using an S1 to access care in France, not only the 'migrants britanniques', mentioned in the OP.

If this is not the case, it would appear that Brits are being discriminated against, as I believe the Brexit agreement ensured that those resident before the cutoff date would continue to enjoy all the rights accorded to EU citizens which they had previously. (If "rights" is the correct word)

Does anyone know of an EU citizen using an S1 for medical cover who has qualified for CSS since 1/4/22 - the apparent date of the new ruling?
